US solar cell import rules: what to clear before the flight
A practical checklist for shippers and forwarders moving photovoltaic cells and modules into the United States by air. Not legal advice — work through it with your licensed customs broker.

1. Classification
Photovoltaic cells that are not assembled are classified under HTS 8541.42; cells assembled into modules or made up into panels under 8541.43. The classification drives which duty measures apply, so it belongs at the start of the checklist, not at the airport.
2. Origin — of the cell, the wafer and the polysilicon
US measures on solar products look at where things were made, and different measures look at different stages of the supply chain. Customs origin, the scope of an antidumping order and the forced-labour rules are separate tests. Document each stage: polysilicon, wafer, cell and module.
The route of the flight is irrelevant to all of them. Flying modules from China via Southeast Asia, the Middle East or Africa does not change their origin, and CBP investigates transshipment and evasion under the Enforce and Protect Act.
3. Section 301 duties on Chinese origin
Solar cells of Chinese origin carry a Section 301 duty that the US Trade Representative raised in its four-year review. Wafers and polysilicon of Chinese origin have been subject to 50 % since 1 January 2025. Check the current rate for your HTS line with your broker; Section 301 lists change.

4. Antidumping and countervailing duties
Crystalline silicon cells from China have been subject to antidumping and countervailing duty orders since 2012. In 2025 orders were added for cells from Cambodia, Malaysia, Thailand and Vietnam. Rates are set per producer and can be many times the value of the goods, and cash deposits are due at entry.
Ask your supplier for the producer and exporter names that match a Commerce rate, and have your broker confirm the scope before you commit to a charter.
5. Forced labour: the UFLPA
The Uyghur Forced Labor Prevention Act presumes that goods made wholly or partly in Xinjiang were made with forced labour and may not be imported. Polysilicon is a priority sector for enforcement, so PV shipments are detained when the importer cannot trace the supply chain back to the polysilicon.
Prepare the tracing documents before departure. A detained charter load stays in a bonded warehouse while the evidence is reviewed — storage costs run from the first day.
6. Section 201 and other measures
The Section 201 safeguard on crystalline silicon cells and modules was extended by Proclamation 10339 until 6 February 2026. Further tariff measures have changed several times in 2025 and 2026; confirm with your broker which ones apply on the day of entry, not on the day of booking.
7. What is different for air freight
Advance cargo data must reach CBP no later than before loading. With a charter, the time between booking and arrival is short, so documents that a sea shipment could complete during transit must be ready before the aircraft is loaded.
Agree in advance who is importer of record, who files the entry and who pays duties and deposits on arrival. On a charter, a single open question can hold the whole aircraft load.

Questions
What is the HTS code for solar cells?
8541.42 for photovoltaic cells not assembled into modules, and 8541.43 for cells assembled into modules or made up into panels.
Does shipping solar panels from China via another country avoid US duties?
No. Duties and import rules follow origin, not the route. CBP investigates transshipment that hides the origin under the Enforce and Protect Act.
Why are solar shipments detained by US customs?
Most often under the UFLPA, when the importer cannot document that the polysilicon in the cells was not produced in Xinjiang.
Is the Section 201 solar tariff still in force?
Proclamation 10339 extended it until 6 February 2026. Check with your customs broker which measures apply on your entry date.
